NATH ORAL ORDER 10-04-2015 Heard the learned counsel for the petitioner and learned additional public prosecutor.

The petitioner seeks regular bail in connection with Uchkagaon P.S.Case No.113 of 2014 registered under Section 395 of IPC.

The learned counsel for the petitioner has submitted that no T.I. Parade has been done to ensure the identification of the petitioner. It has also been submitted that the petitioner is in custody since 23.08. 2014.

The learned additional public prosecutor however, has submitted that the petitioner has confessed in another case regarding his involvement in the present case. It has also been submitted that there are materials in the case diary against the petitioner.

After hearing the parties and considering the

Patna High Court Cr.Misc. No.51734 of 2014 (3) dt.10-04-2015 submissions, it transpires that the petitioner himself has accepted to be involved in three earlier cases out of which one case Barharia P.S.Case No. 349/2014 is under Section 394 of IPC. The offence is with regard to Dacoity in a petrol pump at National Highway.

In view of the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the application is rejected.
