JUSTICE PRABHAT KUMAR JHA ORAL ORDER 09-09-2019 The learned counsel for the petitioners submits that petitioner No.2, Brijnandan Yadav, has already been arrested. Accordingly, the prayer for anticipatory bail of petitioner No.2 is dismissed as has become infructuous.

Heard both sides.

The petitioners apprehend their arrest in Singhwara P.S. case No. 33 of 2019 registered under Section 363, 366A of the IPC.

The informant alleged that petitioners and others kidnapped his minor daughter for establishing illicit relation. The learned counsel for the petitioners submits that besides the facts that the FIR was lodged after much delay the victim disclosed only the name of Satish Kumar. There is no material that the petitioners kidnapped the daughter of the informant. The victim herself disclosed that nobody did any

Patna High Court CR. MISC. No.56412 of 2019(2) dt.09-09-2019 2/2 illegal act with her but she was confined in a room and she identified only Satish Kumar among the persons who kidnapped her.

Taking into consideration the facts that victim herself did not disclose the name of petitioners and on mere suspicion the informant named the petitioners and alleged that petitioners kidnapped his daughter, the petitioners No. 1 and 3, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Singhwara P.S. case No. 33 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
