====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-09-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 191, 190, 126(2), 115(2), 119(2), 324(3), 74, 326(a) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., on 30.12.2024, these petitioners set the crop of informant on fire and demolished his boundary wall.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.57388 of 2025(2) dt.02-09-2025 2/3 petitioners are innocent and have committed no offence. As a matter of fact, the land on which the said boundary wall was constructed was purchased by petitioner no. 1 through registered sale deed and the crops also belong to these petitioners. It is further submitted that due to land dispute and enmity between the parties, informant and her associates themselves set the crops on fire. Present case is counter blast of Bodhgaya P. S. Case No. 06 of 2025 which was lodged by petitioner no. 1 against informant and others which is earlier in point of time and to save their skin from the aforesaid case, this false and concocted case. Petitioner nos. 1, 2, 3, 5, 6, 7 claim clean antecedent and petitioner no. 4 has got one criminal antecedent in which he is on bail.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the backdrop of the case and nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate,
