ANJANA MISHRA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.05.2019 in connection with Gogari P.S. Case No.157 of 2019 registered for the offence under Sections 147, 148, 447, 341, 385, 379, 307, 354A, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that there is only an omnibus allegation of assault against all the accused persons, including the petitioner. It is further submitted that the F.I.R. has been lodged as a sequel to another case filed by one Akhilesh Pandit. It is submitted that one Gogari P.S. Case No.149 of 2018 for the offence under Section 366A/34 I.P.C. had been lodged against the
Patna High Court CR. MISC. No.55656 of 2019(2) dt.19-09-2019 2/2 petitioner, in which he has been granted bail in view of the fact that the daughter of the informant Chandani Kumar has given a statement in favour of the present petitioner under Section 164 Cr.P.C. and thereafter the petitioner was released and thereafter is leading a happy conjugal life with said Chandani Kumari. It is further submitted that only to wreak vengeance, the informant's side has filed this false case. Considering the aforementioned facts and circumstances and that the petitioner has already been in jail custody for four months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-3rd, Khagaria, in connection with Gogari P.S. Case No.157 of 2019.
