Petitioner apprehends arrest in connection with Barari P.S. Case No. 133 of 2017 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the present first information report has been lodged after delay of one month without any explanation. As a matter of fact, there was free fight in between the informant's family and co-accused persons in which both sides sustained injuries, for which Barari P.S. Case No. 99 of 2017 was lodged. Petitioner, being agnate, was making pairvi for the co-accused and due to that the present false case has been lodged. Petitioner has no criminal antecedent.

No.35535 of 2017(3) dt.11-09-2017 2/2 Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 133 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
