Learned counsel for the respondent is present. It would appear from perusal of the record that this Court vide order dated 17.07.2017 fixed this appeal under the heading for hearing in the 1st week of August 2017 but when the hearing of this appeal was taken up on two occasions, the appellant failed to appear before this Court. However, this Court adjourned hearing of this appeal twice and again today the appellant fails to appear before this Court. Therefore, in the aforesaid circumstance, this appeal stands dismissed for non- prosecution.
