Petitioners apprehend their arrest in a case registered for the offence punishable under Section 354 of the Indian Penal Code and u/s 10 of POCSO Act.

As per the prosecution case, all the three petitioners are alleged to have tried to outrage the modesty of the victim. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case due to previous enmity. It is further submitted that police after investigation submitted final form against the

Patna High Court CR. MISC. No.69611 of 2021(2) dt.20-07-2022 2/2 petitioners but learned court below after differing with the final form took cognizance against the petitioners. Petitioners have got clean antecedent.

Learned counsel appearing for the State and the informant vehemently opposed the prayer for anticipatory bail. Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cumSpecial Judge, POCSO Act, Samastipur in connection with Mahila PS case No. 15/ 2017, subject to conditions laid down u/s 438(2) of the Cr. P. C.
