The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code and Section 45 of the Bihar Cooperative Act.
Allegation against the petitioner is that he had not made over the charge of the register and other documents when he was Adhyaksh of the PACS. The petitioner has not produced any supporting documents to substantiate that charge of register etc. was also handed over at the time of relinquishment of the charge. Considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly,
Patna High Court Cr.Misc. No.51953 of 2016 (6) dt.20-04-2017 his prayer for anticipatory bail in connection with Patepur P.S. Case No.69 of 2016 pending in the court of learned Chief Judicial Magistrate, Vaishali at Hajipur is refused.
In the event of surrender, the court below shall not prejudice by the present order of this Court. (Birendra Kumar, J) Arvind/- U T
