The petitioner apprehends arrest in connection with Belsand P.S.Case No.98 of 2016 pending in the Court of Judicial Magistrate, Ist Class, Sitamarhi registered for an offence under Sections 304(B) and 201/34 of the IPC.

This petitioner is the husband of the deceased. The marriage of this petitioner had taken place for about two years ago. It has been alleged that he committed murder of his wife as further demand of dowry was not fulfilled. From the impugned order, it appears that the informant in his statement and other witnesses have supported the allegation of dowry demand. The death took place within two years from the date of marriage in matrimonial house in suspicious manner and dead body was

Patna High Court Cr.Misc. No.39397 of 2017 (2) dt.21-08-2017 2/2 cremated hurriedly without informing the family members of deceased.

Considering the nature of allegation and the facts and circumstances, the prayer for anticipatory bail of the petitioner is rejected.
