2. Petitioner seeks regular bail in connection with Barachatti P.S. Case No. 113 of 2024, in a case registered for the offences punishable under Sections 8(b), 18 and 29 of the NDPS Act.

3. As per prosecution story, petitioner along with other co-accused persons is involved in cultivation of opium on forest land.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The land over which opium plants were cultivated does not belong to the petitioner and there is no direct evidence against this petitioner. Similarly situated co-accused person

Patna High Court CR. MISC. No.59493 of 2025(2) dt.17-10-2025 2/2 namely, Rahul Kumar has been granted bail by this Court vide order dated 18.07.2024 passed in Cr. Misc. No. 42351 of 2024. Petitioner is in custody since 21.05.2025.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge, NDPS Act, Gayaji, in connection with Barachatti P.S. Case No. 113 of 2024.
