The petitioner has prayed for bail in a case instituted for the offence under Sections 447, 341, 323/34 of the Indian Penal Code and later on sections 147, 149, 307, 302 and 504 IPC were added.

As per allegation in the FIR, on the ancestral land of the informant, petitioners and 50-60 unknown persons came to grab his land. On protest, accused persons assaulted the informant and his brother by means of lathi and danda and during treatment Jang Bahadur Singh died at PMCH after few days.

Patna High Court CR. MISC. No.60715 of 2023(4) dt.02-12-2023 2/2 It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case. They have committed no offence. General and omnibus allegations have been levelled against the petitioner. In the background of the alleged occurrence, there is land dispute. Petitioners have got clean antecedent and languishing in judicial custody for about six months.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Munger in connection with Kharagpur P.S. Case No. 371 of 2023.
