Informant had alleged that while deceased Pramod Yadav, his brother was going to his Basa over motorcycle, he was intercepted by the criminals who made indiscriminate firing whereupon the deceased died. Furthermore, he named so many persons including petitioner responsible for causing death of his brother.

During course of investigation, it is apparent that majority of the witnesses have not named any of the accused though substantiated the occurrence, save and except once Hemant Yadav who happens to be maternal uncle of informant as well as deceased.

Apart from this, nine persons have been named to

Patna High Court Cr.Misc. No.52083 of 2016 (3) dt.23-12-2016 have made firing against which only three fire arm injuries have been found over the person of the deceased. Moreover, other coaccused are found bailed out vide Cr.Misc. Nos. 56553/2015, 32955/2016, 52183/2015, 44232/2015, 20662/2015 and 5118/2015.

Accordingly, petitioner, Babblu Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sanjay Kumar, Judicial Magistrate-1st Class, Jamui in Chandradeep PS Case No. 70/2014 (Aditya Kumar Trivedi, J) perwez U T
