JUSTICE SUDHIR SINGH ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 149, 341, 323, 302 and 504 of the I.P.C.

Allegation is that the accused persons including the petitioner assaulted on the head of the father of the informant. He was taken to the Hospital for treatment, but the doctor declared him dead.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.7.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus

Patna High Court Cr.Misc. No.52014 of 2016 (2) dt.14-12-2016 2/2 allegation has been made. No specific injury has been attributed against the petitioner. The other co-accused has been granted bail vide Annexures 2 and 3 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Taraiya P.S. case No.116 of 2015.
