2. The petitioner has prayed for bail in a case instituted for the offence under Sections 147, 148, 149, 307, 379, 341, 323, 504 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per allegation in the FIR, while the informant was selling vegetables, petitioner and his four friends came to his shop for purchasing vegetables. And on demand of cost of the vegetable, petitioner demanded ransom of Rs. One lakh from him. On refusal, they snatched his cash of Rs. 6,000/- and petitioner along with his 4-5

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Allegedly occurrence took place in the year 2018 but till date, no injury report of injured persons is brought on record to support the prosecution story. In para 4 of the case diary statement of the injured Ramesh Kumar Singh is mentioned in which he stated that he received bullet injury in his right leg and injured Shankar Singh also received bullet injury on his thigh, which are not vital parts. No specific allegation of firing is attributed to the petitioner. Petitioner is languishing in judicial custody since 10.6.2023.
5. The application for bail is opposed by learned APP for the State and submitted that petitioner is named accused.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only)
