JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner as well as learned counsel for the State.

In this application for anticipatory bail, the petitioner apprehends his arrest for the offences punishable under Sections 341, 323, 325, 307, 448, 380 and 504/34 of the Indian Penal Code.

Allegedly, the petitioner and his wife assaulted with iron rod which hit the head, hand, palm and finger of the informant and when the daughter of the informant came to rescue him, she was also assaulted with rod by the petitioner and his wife and they took away box containing ornaments and a cash of Rs. 25,000/-.

Patna High Court Cr.Misc. No.51505 of 2016 (2) dt.19-12-2016 2/2 Submission is of false implication and that there is general and omnibus allegation against them, there is land dispute between the parties, the wife of the petitioner has already been allowed pre-arrest bail by the learned Sessions Judge itself and the case of the petitioner is on similar footing, injury on the head has been found simple in nature and besides that there is no injury on the vital part. The learned A.P.P. opposes the prayer for bail. In the facts and circumstances stated above, petitioner Rishu Kr. Singh, in case of his arrest or surrender before the Court below within four weeks from the date of receipt/ production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in Kurtha P.S. case no. 149 of 2016 subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
