JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 2591-b) a and 26 of the Arms Act.
Allegation against petitioner is that he was apprehended by police having a country made pistol and two live cartridges. It has been submitted on behalf of petitioner that he is in custody since 23.8.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. It is alleged that one country made pistol along with two live cartridges is said to have been recovered from possession of petitioner. There is no compliance of Section 100 of the Code of Criminal Procedure. It is further submitted that petitioner may be released after completion of five months in custody, i.e., from 23.8.2016.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of
Patna High Court Cr.Misc. No.51271 of 2016 (2) dt.05-12-2016 2/2 five months in custody, i.e., from 23.8.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VI, Buxar, in connection with Sikroul P.S. Case no. 51 of 2016.
