This writ application has been preferred for a direction to the respondent to provide police protection to the petitioner and her family for performing her marriage schedule to be held on 29.10.2018 with one Md. Afzal Khan. The petitioner has expressed apprehension that her marriage may be disturbed by her own maternal father, maternal mother and maternal uncle.
Learned Senior Counsel representing the petitioner submits that from perusal of Annexure-1 which is a copy of Aadhar Card of the petitioner, it would be evident that her date
Patna High Court Cr. WJC No.2061 of 2018(2) dt.25-09-2018 2/3 of birth is 01.01.2000, she is aged more than 18 years and is major in the eye of law. It is submitted that the family of the mother of this petitioner are not liking the marriage of the petitioner with said Md. Afzal Khan and, therefore, they are threatening the petitioner and her family.
In the given circumstance, the prayer is that she should be given adequate protection and in this regard she has submitted her representation to the District Magistrate, Gopalganj and the Superintendent of Police, Gopalganj also. Learned counsel for the State is present.
In the nature of relief prayed in the writ application, no notice need be issued to private respondent no. 4. Since the petitioner is looking for protection so far that her marriage should not be disturbed, Superintendent of Police, Gopalganj and the S.H.O. of Vijaipur Police Station, District Gopalganj are directed to look into the matter, take stock of the situation after meeting the petitioner and the family members of the petitioner and in case it is found that their apprehension of getting disturbance in the marriage are genuine and her marriage is likely to be disturbed by any person, the Superintendent of Police, Gopalganj and the S.H.O. of Vijaipur Police Stanton both shall be obliged to make adequate
Patna High Court Cr. WJC No.2061 of 2018(2) dt.25-09-2018 3/3 arrangement to protect the petitioner and her family so that marriage scheduled on 29th October, 2018 may take place without any disturbance.
