JUSTICE SANJAY PRIYA ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged in the written report that on the date of occurrence Upendra Kumar Sahwadi, Shambhu Prasad Singh made indiscriminate firing whereas two persons namely, Rakesh Kumar and Subhash Singh were driving the motorcycles. The petitioner is not named in the First Information Report. From the order of the learned Sessions Judge, Buxar, it appears that the name of the petitioner has come in the confessional statement of one Raj Kumar Ram during investigation. Besides this, no other specific material has been
Patna High Court Cr.Misc. No.51659 of 2016 (3) dt.13-01-2017 2/2 brought against the petitioner. The learned Sessions Judge has mentioned in detail about the materials brought by the police during investigation.
Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Buxar, in connection with Sikroul P.S.
