2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103 (1), 238 and 3 (5) of the BNS.
3. The case of the prosecution is that the informant alleged that on 01.11.2024 at about 8:00 P.M. the co-accused, Anita Devi called her son, Tuntun Kumar Singh @ Ledhu Singh (now deceased). On receiving the call, he left his house but did not return. Subsequently, on 03.01.20245, the dead body of the deceased was found laying near village, Gudmara. The informant is the mother of the deceased.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.57200 of 2025(3) dt.22-12-2025 2/3 petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that from perusal of the FIR, it is apparent that the informant has only suspected that the petitioner along with others had killed the deceased. It is further submitted that there is no eye witness to the occurrence in the present case. From perusal of the case diary, it is also also clear that the deceased used to talk with Anita Devi, the wife of the petitioner, and during the course of investigation, it has also come that the deceased was having illicit relationship with the wife of the petitioner.
It is further submitted that in the present case, co-accused, Sintu Pandit @ Sintu Kumar Pandit has also given his confessional statement wherein he has stated that deceased was having illicit relationship with the wife of the petitioner that is why, the alleged offence was committed. It is further submitted that similarly situated co-accused persons namely, Sanjay Choudhary @ Sanjay Choudhari, Shrawan Choudhary, Rajiv Pandit @ Rajeev Kumar Pandit and Sintu Pandit @ Sintu Kumar have been extended the privilege of bail vide orders dated 13.05.2025 and 16.05.2025 passed in Cr. Misc. Nos. 15519 of 2025 and its analogous case as also Cr. Misc. No. 23108 of 2025 and its analogous case.
Patna High Court CR. MISC. No.57200 of 2025(3) dt.22-12-2025 3/3 is languishing in judicial custody since 07.11.2024 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jhajha P.S. Case No. 499 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui.
