This is a petition for grant of regular bail for offence under Sections 341, 323, 324, 147, 148, 149, 448, 307, 302 and 504 of the Indian Penal Code.
The allegation is of assault committed by eighteen named accused person, including the petitioner, as a result whereof Dhruv Sharma died. Submission of the petitioner is that there is no specific allegation against the petitioner and the post mortem report was perused at the time of hearing of the regular bail application of Dinesh Sharma in Cr. Misc. No. 44433 of 2013, which revealed that injuries on neck was found as the cause of death. His, further, submission is that Dinesh Sharma has already been granted bail by another Bench of this Court on 23.09.2015 in the aforesaid criminal miscellaneous case.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kangali P.S. Case No. 26 of 2015 to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah, or successor Court.
