The petitioner seeks pre-arrest bail in connection with Hajipur Mahila P.S.Case No. 15 of 2017 registered under Section 366-A of the Indian Penal Code read with Sections 4, 6, 8 and 10 of the Protection of Children from Sexual Offences Act. Considering the assessment of age of the victim as 18 years made by the learned Magistrate, who recorded her statement under Section 164 of the Code of Criminal Procedure and the statement of the victim under Section 164 of the Code of Criminal Procedure in which she categorically stated that she married the petitioner out of her own sweet will and is happily living in her sasural, in the event of arrest or surrender before the

No.46093 of 2017 (2) dt.04-10-2017 2/2 court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, POCSO-cum-A.D.J.-I, Vaishali at Hajipur in connection with Hajipur Mahila P.S.Case No. 15 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
