JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Ismilepur P.S. Case No. 34 of 2013 arising out of Complaint Case No. 142 of 2013 registered under Sections-406, 420, 467, 468, 471 of the IPC and 76 Chit Fund Act.
The accusation against the petitioner is that he took some cash from the informant on the pretext of purchasing the land and subsequently, he agreed to transfer some lands to the informant but later on, he refused to do so and got deposited the amount of the informant in a chit fund company. Furthermore, when the informant requested the petitioner to get his amount withdrawn from the aforesaid chit fund company, the petitioner

Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of the order in the court below shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ismilepur P.S.
