JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-1120172017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bhawanipur P.S. Case No. 130 of 2017 registered for the offence punishable under sections 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner is the husband of the deceased. Petitioner never assaulted the deceased. The allegations levelled are general and omnibus and nothing specific has been alleged against this petitioner. This is a case of suicide.

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner being the husband was very much responsible for maintaining and keeping his wife with full honour and dignity, in which he failed. Moreover,

Patna High Court Cr.Misc. No.47882 of 2017(3) dt.28-11-2017 2/2 during investigation witnesses have supported the prosecution case.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
