Petitioner apprehends arrest in connection with Barachatti P.S. Case No. 292 of 2022 registered for the offence under sections 409 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case due to dirty village politics. The work in question was completed on 31.03.2019. Petitioner has handed over the charge of the post of Ward Sachiv to one Sonu Kumar and Ramdeo Manjhi on 01.06.2022. The scheme was for Rs. 15,38,800/- and
Patna High Court CR. MISC. No.56786 of 2022(8) dt.09-02-2023 2/2 payment was made for Rs. 11,46,000 and petitioner has not withdrawn the excess amount till now. Petitioner has no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate, Sherghati, Gaya in connection with Barachaqtti P.S. Case No. 292 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
