The petitioner apprehends his arrest in connection with Phenhara P. S. Case No. 62 of 2016 instituted under Sections 147, 148, 149, 379, 504 and 354B of the Indian Penal Code. The allegation, in brief, is that accused persons came to the house of the informant and started abusing and assaulting him with fist and slaps and when female member came to rescue him, this petitioner torn her garment.

Submission is that there is a case and counter case in between both sides and earlier case was lodged from petitioner's side thereafter this counter case with false allegation was filed to put pressure and the petitioner has no criminal antecedent. Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.37728 of 2017 (2) dt.16-08-2017 2/2 circumstances, let the petitioner, namely, Md. Fakruddin in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Phenhara P.S.Case No. 62 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
