JUSTICE RAJIV ROY ORAL ORDER 01-09-2025 Learned counsel for the petitioner prays for and is allowed to implead the Arbitrator cum Divisional Commissioner, Saran at Chapra as respondent no.8 in course of the day.
2. Heard the parties.
3. The present petition has been preferred for the following relief/s:
(i) for issuance of mandamus against the
2/4 respondent(s) concerned to grant fair compensation to the petitioner as per Right to Fair Compensation and Transparency in Land Acquisition and Representation Act, 2013 and Rules made there under with respect to the proposed acquisition of the land of the petitioner;
(ii) for issuance of mandamus against the respondent(s) concerned to grant fair Land Acquisition Amount Compensation, solarium and others to the petitioner;
(iii) for issuance of direction against the respondent(s) concerned for the necessary amendment in the Award No. 25 dated 05.02.2025 issued under the signature of the competent authority-cum- District Land Acquisition Officer, Siwan in Land Acquisition Case No. 15/2024-25 with respect to the acquisition of the land of the petitioner bearing Khata No. 34, Plot No.
99, Arazi 0.004049 hectare situate in revenue village Sarea, Circle, Guthani,
3/4 District- Siwan;
(iv) for any other relief(s) for which the petitioner would be found entitled by this Hon'ble High Court, Patna in the facts and circumstances of the case..
4. The matter relates to Ram Janki Path Project National Highway-227(A) for which the acquisition process has been initiated.
5. At the outset, learned State counsel took this Court to the document (Annexure-3 of the petition) to show that the petitioner herself has requested the District Land Acquisition Officer, Siwan giving out the details where the compensation amount is to be deposited.
6. In that background, if aggrieved, she should have moved before the Arbitrator cum Divisional Commissioner, Saran at Chapra for the redressal of the grievance.
7. Learned counsel for the petitioner submits that she shall be approaching the concerned respondent (respondent no.8) in next four weeks.
7. If such petition is preferred in next four weeks, the Arbitrator cum Divisional Commissioner, Saran at Chapra shall ensure after hearing all the parties, the matter is taken to its
4/4 logical conclusion by 31.03.2026.
8. The writ petition is disposed of with the aforesaid observation.
