2. The petitioner is apprehending his arrest in a case in connection with Mansi P.S Case No. 140 of 2022 dated 28.04.2022 registered for the offence punishable u/s 341, 323, 326, 307, 506 read with section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons along with three unknown miscreants holding lethal weapons were standing at Basa of Nepali Singh. On being asked, Aman Yadav, Ramen Yadav and Ranjeet Yadav started assaulting the informant and the co-

No.65445 of 2024(2) dt.20-11-2024 2/3 accused Ranjeet Yadav caught hold of him and the petitioner Ramen Yadav @ Ravin Kumar @ Rabin Kumar Yadav @ Ramesh Yadav @ Ramayan Yadav fired on the stomach of the informant. Thereafter, the informant was taken to the Sadar Hospital for treatment.

4. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. It is further submitted that during the course of the investigation, the allegation of firing is against one Ranjit Yadav and as such final form was submitted against the petitioner showing not sent up for trial. It is further submitted that in spite of submitting final form showing not sent up for trial, the cognizance has been taken against the petitioner. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioner by submitting that there is specific allegation of firing against the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and the heinous nature of allegation against the petitioner, I am of the view that no case

No.65445 of 2024(2) dt.20-11-2024 3/3 for grant of anticipatory bail is made out and the same is rejected with direction to the petitioner to surrender before the Court below concerned within six weeks from the date of this order and the prayer for regular bail, the learned Court below may consider his prayer for regular bail in accordance with law and on its own merit without being prejudiced by this order.
