1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Mahindwara Police Station Case No. 110 of 2022, disclosing offences under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.

3. As per the FIR, the police got the information that some miscreants have assembled near Korlahiya Maharani Asthan, where Shivam, along with four to five unknown persons, was present and they were preparing to commit crime. Upon such information, police reached at the place of occurrence and arrested Shivam Kumar and Bhawan Kumar, and from their possession, one country-made pistol, cartridge, and knife were recovered. The petitioner and others succeeded

Patna High Court CR. MISC. No.56899 of 2025(2) dt.17-02-2026 2/3 in fleeing away. The arrested accused persons disclosed the name of the petitioner and others who succeeded in fleeing away.

4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of statement made by the arrested co-accused persons. Petitioner is aged about nineteen years having no criminal antecedent.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner is having no criminal antecedent and he is of tender age of nineteen years, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Mahindwara Police Station Case No. 110 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section
