2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 118(1), 117(2), 109, 329(3), 303(2), 352, 351(2) of BNS.

3. Allegation in the FIR is that the petitioners came variously armed and assaulted the informant and his family members. Further, there is specific allegation on Satyendra Yadav and Amarjeet Yadav of assaulting Bhola Yadav and Raju Yadav with iron rod.

4. Learned counsel for the petitioner submits that it would be evident from the FIR that so far as present petitioner is concerned there is general and omnibus allegation of assault

Patna High Court CR. MISC. No.59064 of 2025(2) dt.29-08-2025 2/2 against him and the petitioner is only said to be a member of the mob of about 13 accused persons. It is further submitted that there is delay of one day in filing the FIR.

5. Learned APP, however, opposes the grant of anticipatory bail.

Taking into consideration the facts and circumstances of the case and also considering the fact that there is general and omnibus allegation on the petitioner and injuries sustained are simple in nature, let the petitioner, above named, who has no criminal antecedent in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bishambharpur P.S. Case No. 169 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
