JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner. Despite repeated calls, none appears on behalf of the State. The petitioners seek anticipatory bail in connection with Sikarahatta P.S. Case No. 50 of 2015 registered under Sections 341, 323, 504, 506 read with 34 of the Indian Penal Code and Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989.
It is contended that the petitioners are innocent and they have been falsely implicated in this case. No occurrence as alleged has ever taken place. Due to some confusion and misunderstanding the informant has lodged the case. After coming to know about true facts, the informant has settled the matter
Patna High Court Cr.Misc. No.50510 of 2015 (2) dt.05-11-2015 2/2 outside the court with the petitioners as the petitioners and the informant are teachers of the same school. It is further contended that a joint compromise petition and an application seeking permission to compromise the matter have already been filed in the court below. The further contention is that the matter was verified by the Block Education Officer pursuant to the direction issued by the Sub Divisional Officer and he found that the allegation as alleged against the petitioners is not true. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.
10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bhojpur, Ara in connection with Sikarahatta P.S. Case No. 50 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
