ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.07.2019 in connection with Excise Case No.235 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries 53.460 litres of illicit liquor were not from the conscious possession of the petitioner. The petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.55167 of 2019(2) dt.05-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge Cum Special Judge, Excise, Gopalganj, in connection with Excise Case No.235 of 2019.
