JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kusheshwar Asthan P.S. Case 167 of 2013 instituted for the offence under Sections 147, 148, 149, 342, 379, 302 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted that petitioner is not named in the First Information Report. His name has come in the supervision note of the police.

As per written report there is specific allegation of making firing against Hare Ram Sada on the order of one Ram Bilash Sada. Petitioner is said to be in custody since 27.9.2016. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

No.727 of 2017 (7) dt.07-08-2017 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned learned Sub Divisional Judicial Magistrate, Biraul (Darbhanga), in connection with Kusheshwar Asthan P.S. Case No. 167 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
