The petitioner seeks bail in Deepnagar P.S. Case No. 70 of 2021 corresponding to Sessions Trial No. 485 of 2021, registered for the offence punishable under Sections 302, 120(B), 34 of the Indian Penal Code and section 27 of the Arms Act.

FIR is registered against unknown for the occurrence of murder of informant's son by firearm.

It is submitted on behalf of the petitioner that name of this petitioner transpired in this case on the basis of confessional statement of co-accused Bhosu Yadav @ Rintu Kumar. It is further submitted that one Khushbu Kumari who was planted by the co-accused Bhosu Yadav to trap the deceased, has not taken name of this petitioner in her statement under Section

Patna High Court CR. MISC. No.69049 of 2021(3) dt.21-04-2022 2/2 164 Cr.P.C. Even as per the confessional statement this petitioner is only alleged to have played the role of liner. Petitioner claims clean antecedent and he is in custody since 11.03.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Biharsharif, Nalanda in connection with Deepnagar P.S.
