JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 This application, for grant of anticipatory bail, arises out of Doriganj P.S. Case No. 94/2019, disclosing offences under Sections 420, 379 and 34 of the Indian Penal Code. Prosecution case is of recovery of 32 packets of rice and 19 packets of wheat from a pick up van, which appeared to be food grains under Public Distribution System and the driver of the van disclosed the name of petitioner . Submission of learned counsel for the petitioner is that save and except the disclosure made by the driver of the van, there is nothing against the petitioner and there is enmity between the petitioner and the witnesses of seizure list and a title suit is going on between the parties.

Having heard both sides, considering the submission,
Patna High Court CR. MISC. No.54612 of 2019(2) dt.02-09-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Chapra, in connection with Doriganj P.S. Case No. 94/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure it is also subject to the condition that petitioner will cooperate in investigation and make himself as and when required by the Investigating Officer.
