The petitioner seeks pre-arrest bail in connection with Kadirganj P.S. Case No. 71 of 2019 for the offences alleged under Sections 341, 323, 504 and 354B/34 of the Indian Penal Code.

The accusation is that informant, Baby Kumari, was at her house, at that time her uncle, Keshav Prasad, and his two sons, Ranjeet Kumar (petitioner) and Sujit Kumar, came and told her that they will made pillar regarding which informant made protest, then, she was abused and she was assaulted through fists and slaps. In the meantime, with bad intention torn her clothes.

The submission of the learned counsel for the petitioner is that due to land dispute hot words exchanged

Patna High Court CR. MISC. No.54780 of 2019(2) dt.30-08-2019 2/2 in between family of the petitioner and family of the informant and quarrel also took place regarding which Kadirganj P.S. Case No. 70 of 2019 is also instituted under Sections 341 and 323/34 of the Indian Penal Code against the informant of present case and her family members. Petitioner has no criminal antecedent. Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Kadirganj P.S. Case No. 71 of 2019 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Masaurhi, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
