2. The petitioner seeks bail in a case registered for the offences punishable under Sections 121, 121(A), 122, 126(2), 115(2), 109, 303(2), 352, 351(3), 3(5), 191(2), 191(3) and 190 of B.N.S., 2023.

3. As per prosecution case, the allegation is that after the victory in PACS election, the informant took out a victory procession and when the procession reached near the house of Kari Yadav, the F.I.R. named accused including this petitioner along with 10-15 unknown persons variously armed with deadly weapons started hitting the informant and when Jeewachh

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case due to political rivalry. The doctor has found the injury simple in nature. There is case and counter case. Petitioner has got clean antecedent and is in custody since 15.06.2025.

5. Learned A.P.P. for the State and learned counsel for the informant vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sh. Chandan Thakur, learned Judicial Magistrate, 1st Class, Saharsa in connection with Kanaria P.S. Case No. 21 of 2024.
