The petitioner apprehends his arrest in Khodawandpur (Chhaurahi O.P.) P.S. case No. 152 of 2016 for the offences punishable under Section 467, 468 and 420 of the Indian Penal Code.
The Block Development Officer, Chhaurahi, alleged that petitioner got appointment as teacher in the upgraded middle school in the name of Md. Javed Ali Reza and he also took benefits of Government schemes in the name of Md. Javed Imam Manzar.
The learned counsel for the petitioner submits that Md. Javed Ali Reza and Md. Javed Imam Manzar is one person.
Patna High Court Cr.Misc. No.44040 of 2017 (3) dt.10-11-2017 2/2 The petitioner committed no illegality nor took benefit of any Government scheme. The Block Development Officer in his letter No. 1067 disclosed that petitioner Md. Javed Ali Reza is son of Md. Idris and Md. Javed Imam Manzar is not the name of petitioner but it transpired from the enquiry held by the Sub divisional Magistrate that petitioner in the name of Md. Javel Ali Reza got appointment on the post of teacher and he also took benefits of different Government schemes in the name of Md. Javed Imam Manzar. The petitioner filed genealogy showing that Md. Javed Imam Manzar died and submitted his death certificate. It appears that petitioner played fraud.
Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
