Petitioner seeks bail in a case registered for the offences punishable under Sections 395,397 of the Indian Penal Code and 27 of the Arms Act.

The petitioner is not named in the FIR whereas some others are named in the FIR.

Submission is that name of the petitioner surfaced in the confessional statement of co-accused before the police and considering the identical allegation, co-accusedMandal Kumar @ Rajeev Kumar @ Mandal Yadav has already been allowed bail by a Coordinate Bench of this Court in Cr. Misc. No. 32977 of 2017.

Considering the facts aforesaid, let the

No.56933 of 2019(2) dt.13-09-2019 2/2 petitioner, above named, who is in custody since 13.03.2019 and investigation of the case is already complete, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bodhgaya Police Station Case No.145 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
