The petitioner has moved this Court under Section 482 of the Code of Criminal Procedure, 1973 assailing the order of the learned Adhoc A.D.J. III, Gaya dated 07.08.2012 passed in Criminal Revision No. 40 of 2012 by which he has upheld the order dated 08.07.2011 passed by the S.D.M., Sadar (Gaya) directing the petitioner to remove the wall constructed by him on
Patna High Court Cr.Misc. No.41719 of 2012 (2) dt.20-03-2015 2/2 the road.
After some argument, learned counsel for the petitioner seeks permission to withdraw the application with liberty to move before the appropriate forum for declaration of his right, title and possession over the land in question. Accordingly, the application stands disposed off with the liberty aforesaid.
