JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-12-2017 Heard learned counsel for the petitioners, learned counsel for the complainant and the learned A.P.P. for the State. The petitioners apprehend their arrest in connection with Complaint Case No. 3342 of 2013 registered under Section 406 of the Indian Penal Code.
The accusation is that complainant being the proprietor of M/S Sunil Textile supplied the cloths of Rs.1,50,489/- in between 30.10.2007 to 06.02.2008 to M/S Abhishekh Trading Company belonging to petitioner no. 1, Pawan Kumar Poddar and his son, petitioner no. 2, Abhishekh Poddar in terms that they will paid the price of cloths after selling the same. In spite of repeated requested, only Rs.2,000/- was paid by the petitioner till 26.03.2012 and Rs.1,48,489/- is still due.
Patna High Court Cr.Misc. No.41204 of 2017 (3) dt.15-12-2017 Learned counsel for the petitioners submits that due to business rivalry petitioners have falsely been implicated in this case.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-cum-Sub-JudgeVIII, Muzaffarpur, in connection with Complaint Case No. 3342 of 2013, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
