JUSTICE SUDHIR SINGH ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363, 366A and 120B/34 of the I.P.C. The prosecution story, in brief, is that the informant gave her fard beyan that her two daughters aged about 11 and 5 years respectively have been lost on 9.9.2016. On search both are not traced out. The F.I.R. was registered against unknown. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.9.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is a lady. The victim girl has been examined under Section 164 Cr.P.C. She
Patna High Court Cr.Misc. No.52002 of 2016 (3) dt.23-12-2016 2/2 has not named the petitioner. The specific allegation has been made by the victim against the co-accused, namely, Anil Yadav. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VII, Darbhanga in connection with Bishanpur P.S. case No.86 of 2016.
