ANJANA MISHRA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.
The petitioners being grand father in law and mother in law are apprehending their arrest in connection with Ballia P.S. Case No. 8 of 2015, registered for offences punishable under Sections 304B, 201 and 341 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against these petitioners are general and omnibus in nature and all the family members which includes petitioners' immediate family as well as that of the agnates have been made accused. It is further submitted that no specific role has been attached to these petitioners and omnibus allegation regarding demand of dowry has been made leading to the death of the
Patna High Court Cr.Misc. No.47316 of 2015 (2) dt.14-01-2016 2/2 daughter of the informant.
Considering the nature of allegations made against the present petitioners which are neither specific nor distinct and also the fact that the petitioner no. 1 is 82 years old person and petitioner no. 2 mother in law is suffering from multiple diseases, let the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 08 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J) sunil/- U T
