The petitioner seeks anticipatory bail in connection with Manjhi PS case no. 127 of 2013 registered for the offences punishable under Section 417, 418 and 420 of the Indian Penal Code.
The allegation is regarding the petitioner having been working in a Non-Banking Company in the name and style of Goldmine Industries Limited and in the process collecting money from private persons on behalf of the said company by way of fixed deposit and thereafter the said company is said to have defaulcated the money. It is further alleged that the company is said to be running without complying with the RBI Rules and regulations.

No.48074 of 2017 (4) dt.05-02-2018 2/2 The learned counsel for the petitioner submits that there is no allegation of defalcation specifically on the petitioner herein and moreover, the amount defaulted has nowhere been mentioned. It is further submitted that at best the petitioner is an employee of the said company and the liability whatsoever is on the directors and owners of the said company. The petitioner has a clean a antecedent.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of this order, the petitioner above named is directed to be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra in connection with Manjhi PS case no. 127 of 2013, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
