In this case, the petitioner is seeking bail in connection with Sessions Trial No.711 of 2012, arising out of Gaighat P.S. Case No.68 of 2011, registered for the offences under Sections 302, 304(B) and 306 of the Indian Penal Code. Earlier, the petitioner has moved before this Court for bail in Criminal Miscellaneous No.26415 of 2012, which has been rejected after considering the material on record. As per learned counsel for the petitioner eleven witnesses have already been examined in the trial.
Patna High Court Cr.Misc. No.51284 of 2015 (3) dt.30-01-2016 2/2 Looking to the nature of allegation and the stage of the trial, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to conclude the trial as early as possible preferably within a period of six months from the date of receipt / production of a copy of this order.
