No.50606 of 2016 wherein Ajay Sahani is the petitioner commonly originate out of Harsidhi P. S. Case No.134 of 2016, on account thereof, have been heard together and are being disposed

Patna High Court Cr.Misc. No.50606 of 2016 (03) dt.10-02-2017 of by a common order.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutors.

On the point of pistol, informant was overpowered and then thereafter, he was deprived of his belongings including motorcycle, ornaments 50 gm, cash Rs.20,000/-, Aadhar Card, ATM Card, Nokia Mobile and keys.

From perusal of the case diary, it is evident that both the petitioners were arrested in connection with Harsidhi P. S. Case No.245 of 2016 (Para-68) and further, having inculpatory statement at their end as well as one of Mahesh Kumar, their complicity have been traced out followed with submission of chargesheet. So virtually, no legal evidence has been collected by the I.O.

Accordingly, petitioners, Ajay Sahani and Ram Vijay Kumar are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P. S. Case No.134 of 2016.
