The petitioner apprehends his arrest in Baisi P.S. Case No.231 of 2017 registered under Section 7 of the Essential Commodities Act.
According to the prosecution case, the informant intercepted a vehicle bearing Registration No.BR11GA-3751 and apprehended Md. Arman (driver of the vehicle). Md. Arman disclosed that the owner of the vehicle, namely, Md. Nizamuddin loaded rice on the vehicle for selling in open market. The name of petitioner, namely, Nasim Akhtar appears to have surfaced in the F.I.R. itself on the basis of the fact that one ration card standing in the name of Nasim Akhtar (petitioner) was found from the vehicle. Save and except this fact, there is nothing against the petitioner.
