Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner/s : Mr. Arvind Kumar Singh For the Opposite Party/s : APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VIKASH JAIN ORAL ORDER 30-10-2015 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest for the offences alleged under Sections 353 of the Indian Penal Code and under Sections 30 and 33 of the Forest Act registered in connection with Maigra P.S. Case No. 20 of 2015.
3. It is submitted that the petitioner has been falsely implicated as he is merely the driver and not the owner of the tractor in question. It is further submitted that neither the tractor nor the 'Moram' had been seized.
4. Considering however, that the prosecution report itself discloses that the tractor loaded with "Moram' was seized when the petitioner caused an accident with the tractor and managed to flee away, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The bail petition stands dismissed. (Vikash Jain, J) Chandran U T
