The only prayer made in the writ petition is for a direction to the Secretary, Rural Development Department, Govt. of Bihar (respondent no.2) to dispose of the departmental appeal filed by the petitioner against the order of termination dated 21.4.2015 passed by the Special Secretary, Rural Development Department, Govt. of Bihar.

According to the petitioner, the appeal has been heard by the Secretary, Rural Development Department on 18.7.2016 and 26.7.2016 but no final order has been passed as yet. Having heard learned counsel for the parties and instead keeping the writ petition pending, I deem it fit and proper to direct

Patna High Court CWJC No.19531 of 2016 (2) dt.15-12-2016 the Secretary, Rural Development Department to pass final orders on the appeal so preferred by the petitioner and in case the hearing in the appeal stands concluded as stated by the petitioner, let final order be passed within six weeks of the receipt/ production of a copy of this order.

In case the departmental appeal yet remains pending according to Special Secretary requiring any further assistance of the petitioner, let the same be completed and final order be passed within three months of the receipt/ production of a copy of this order.

With the aforementioned observation and direction, the writ petition is disposed of.
