ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 24.07.2019 in connection with Matihani P.S. Case No.92 of 2019 registered for the offence under Sections 420, 414, 465, 120B of the Indian Penal Code and Sections 30(a), 32(ii), 38(i), 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries of 5148 litres of foreign liquor were made from the Balero vehicles and not from the conscious possession of the petitioner. It is further submitted that the petitioner has one criminal antecedent of similar nature, in which he has been granted bail by this Court.

Considering the aforementioned facts and

No.57790 of 2019(2) dt.13-09-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-Cum Special Judge, Excise, Begusarai, in connection with Matihani P.S. Case No.92 of 2019.
