====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 29-11-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence under Sections 341, 323, 504 and 307 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the alleged occurrence took place on 29.06.2015 whereas the F.I.R. has been filed on 05.07.2015 after lapse of almost one week without explaining the plausible delay which creates doubt over the prosecution version. The petitioner is rotting in custody since 27.07.2018.

No.75735 of 2019(3) dt.29-11-2019 2/2 Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII, Sasaram, Rohtas in connection with Nauhatta P.S. Case No. 34 of 2015/ S.Tr. No. 431 of 2018.
